These Terms & Conditions (“Terms”) govern your access to and use of the website, online and mobile services, accounts, booking services, and other services provided by Motion X Millie LLC, doing business as Motion x Millie and/or Motion by Millie (“Motion x Millie,” “Motion,” “we,” “us,” or “our”).

By accessing motionxmillie.com, creating an account, making a reservation or purchase, or otherwise using our digital services, you agree to these Terms. Certain purchases, memberships, packages, classes, events, or other services may also be subject to additional agreements, policies, waivers, or terms presented at the time of purchase or participation.

1. Eligibility and Accounts

You may be required to create an account to book classes, purchase services, manage reservations, or access certain features.

You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. Please notify Motion x Millie promptly if you believe your account has been accessed or used without authorization.

Individuals under the age of 18 may be subject to additional requirements, including consent, agreements, and waivers completed by a parent or legal guardian.

2. Booking and Reservations

Classes, appointments, events, and other services are subject to availability.

Reservations may be made through Motion x Millie’s designated booking platform, website, mobile application, approved third-party platforms such as ClassPass, or other authorized booking methods.

You are responsible for reviewing your reservation details and arriving at the appropriate location at the scheduled time.

Customers arriving more than five (5) minutes after the scheduled start of class may not be permitted to enter, and the studio door may be locked for the safety and experience of the class. A late arrival that results in missed participation may be treated in accordance with the applicable cancellation or no-show policy.

Motion x Millie may establish reasonable booking windows, waitlist procedures, arrival requirements, and other scheduling rules.

3. Cancellations, Late Cancellations and No-Shows

Unless different terms are expressly disclosed for a particular service or booking method, reservations must be canceled at least eight (8) hours before the scheduled class time to avoid a late-cancellation charge.

A cancellation made less than eight (8) hours before the scheduled class time is considered a late cancellation and is subject to a $10 late-cancellation fee.

Failure to attend a reserved class without timely cancellation is considered a no-show and is subject to a $15 no-show fee.

Depending on the membership, package, promotion, or booking method used, a late cancellation or no-show may also result in forfeiture of the applicable class credit where disclosed at booking or purchase.

Reservations made through third-party platforms, including ClassPass, may also be subject to that provider’s cancellation, no-show, credit, and fee policies.

Motion x Millie may update its cancellation and no-show policies prospectively. Updated policies will be communicated through our booking platform, website, purchase terms, or other appropriate means.

4. Purchases, Memberships and Class Packages

Motion x Millie may offer memberships, class packages, individual classes, appointments, events, promotions, retail products, and other services.

Prices and applicable purchase conditions will be disclosed at or before purchase.

Unless otherwise expressly stated at purchase, current class-package validity periods are:

  • 5-Class Pack: valid for 45 days after purchase;

  • 10-Class Pack: valid for 60 days after purchase;

  • 20-Class Pack: valid for 120 days after purchase;

  • Drop-In Class: valid for 30 days after purchase; and

  • New Client Package: valid for 30 days after purchase.

Unused classes expire at the end of the applicable validity period unless an extension is expressly approved by Motion x Millie or required by applicable law.

Memberships, packages, class credits, and promotional offers are personal to the purchaser and may not be transferred, shared, resold, or assigned to another individual unless Motion x Millie expressly authorizes an exception.

Additional conditions applicable to a particular membership, package, promotion, or service may be disclosed at purchase and will form part of the applicable purchase agreement.

5. Membership Cancellation and Freezes

Where a Motion x Millie membership permits cancellation, 30 days’ notice is required unless different terms are expressly stated in the applicable membership agreement or required by law.

Membership freezes or holds are not automatically guaranteed.

Motion x Millie may approve a temporary membership freeze in limited circumstances, such as documented medical necessity, an extended relocation or move that materially prevents attendance, or another significant circumstance approved by Motion x Millie in its reasonable discretion.

The duration, documentation requirements, effective date, and other conditions of an approved freeze may depend on the circumstances and applicable membership terms.

6. Payments and Fees

You agree to pay all prices, fees, taxes, and other charges associated with purchases and reservations made through your account.

Payments may be processed through third-party payment processors or technology providers.

By providing an accepted payment method, you represent that you are authorized to use that payment method and authorize charges associated with purchases you make.

If a payment is declined, reversed, disputed, or otherwise unsuccessful, Motion x Millie may suspend access to affected services, packages, reservations, or account privileges until the outstanding amount is resolved, subject to applicable law and contractual obligations.

7. Refunds

Except where otherwise expressly stated at purchase or required by applicable law, memberships, class packages, drop-in classes, and other service purchases are nonrefundable.

Motion x Millie may, in its discretion and where appropriate, approve a credit, extension, or other accommodation in exceptional circumstances. Any discretionary accommodation does not create an obligation to provide the same accommodation in another situation.

Nothing in these Terms limits a refund, cancellation, or other consumer right that cannot legally be waived.

8. Studio Policies and Conduct

Customers and guests must comply with reasonable studio rules, safety instructions, equipment requirements, instructor directions, and policies communicated by Motion x Millie.

You agree to conduct yourself respectfully and in a manner that does not endanger, harass, disrupt, or interfere with other customers, instructors, employees, contractors, guests, property, equipment, or studio operations.

Subject to applicable law and contractual obligations, Motion x Millie reserves the right to refuse or discontinue service, remove an individual from the premises, cancel a reservation, or suspend account privileges when reasonably necessary to protect safety, enforce policies, prevent abuse, or address materially disruptive or inappropriate conduct.

9. Fitness Activities, Health and Safety

Participation in Pilates, fitness, exercise, wellness, and related activities involves inherent risks.

You are responsible for determining whether you are physically able to participate in a particular activity and for following instructor directions and reasonable safety instructions.

You should consult an appropriate healthcare professional before beginning or modifying an exercise program when appropriate for your circumstances.

If you experience pain, dizziness, shortness of breath, illness, injury, or another concerning symptom while participating, you should stop participating and seek appropriate assistance.

Motion x Millie does not provide medical advice, diagnosis, or treatment.

10. Waivers and Participation Agreements

Participation in Motion x Millie classes, activities, events, or services may require acceptance of a separate liability waiver, informed-consent document, participation agreement, or other agreement.

These Terms do not replace any applicable liability waiver, membership agreement, purchase agreement, or other agreement.

If there is a conflict between these general Terms and a more specific agreement governing a particular purchase or service, the more specific agreement will control with respect to that subject matter.

11. Minors

Individuals under the age of 18 may participate only in accordance with Motion x Millie’s applicable age and participation requirements.

Where required by Motion x Millie or applicable law, a parent or legal guardian must complete applicable consent forms, waivers, or agreements on behalf of the minor before participation.

Motion x Millie may establish age restrictions for particular classes, equipment, facilities, or services when reasonably appropriate for safety or operational purposes.

12. Email Communications

By providing an email address, you may receive transactional or administrative communications relating to your account, purchases, reservations, schedule changes, policies, or other aspects of your relationship with Motion x Millie.

Where permitted by law and consistent with your preferences, Motion x Millie may also send promotional or marketing emails.

You may unsubscribe from marketing emails using the unsubscribe instructions contained in those communications. This does not prevent necessary non-promotional communications regarding your account, reservations, purchases, or services.

13. SMS and Mobile Messaging

If you separately consent to receive SMS or other text messages from Motion x Millie, we may send messages consistent with the consent you provided.

Messages may include reservation and account information, service updates, studio communications, and promotional messages where you have consented to receive them.

Consent to receive marketing text messages is not a condition of purchasing goods or services.

Message frequency may vary. Message and data rates may apply.

You may opt out of applicable SMS communications by replying STOP. You may reply HELP for assistance or contact hello@motionxmillie.com.

Wireless carriers are not liable for delayed or undelivered messages.

Additional terms or disclosures may be presented when you enroll in a particular messaging program.

Our collection and use of information in connection with SMS communications is also governed by our Privacy Policy.

14. Third-Party Booking Services

Motion x Millie may make certain classes or services available through third-party booking platforms, including ClassPass.

Reservations made through a third-party platform may be subject both to applicable Motion x Millie studio and safety policies and to the third party’s applicable terms, cancellation policies, credit rules, fees, and account requirements.

Motion x Millie is not responsible for the independent operation, account administration, or policies of third-party booking providers.

15. Website and Digital Services

You may use Motion x Millie’s website and digital services only for lawful purposes and in accordance with these Terms.

You may not attempt to gain unauthorized access to our systems, interfere with the security or operation of our services, introduce malicious technology, impersonate another person, or use our services for fraudulent, unlawful, or abusive purposes.

We may modify, suspend, or discontinue portions of our website or digital services from time to time.

16. Intellectual Property

The Motion x Millie website and its content, branding, logos, graphics, photographs, videos, class names, written materials, designs, and other materials are owned by or licensed to Motion X Millie LLC and are protected by applicable intellectual-property laws.

You may access these materials for personal, noncommercial use in connection with our services.

You may not reproduce, distribute, modify, sell, commercially exploit, or create derivative works from protected Motion x Millie materials without prior written permission except where permitted by law.

17. Third-Party Services and Links

Motion x Millie uses and may link to third-party platforms and services, including booking, payment, communications, social-media, and other technology providers.

We are not responsible for the availability, content, privacy practices, security, or independent acts of third-party services we do not control.

Your use of third-party services may also be governed by those providers’ respective terms and policies.

18. Disclaimer

To the fullest extent permitted by applicable law, our website and digital services are provided on an “as available” basis.

Motion x Millie does not guarantee that its website or digital services will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded or limited.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Motion X Millie LLC and its owners, employees, instructors, contractors, representatives, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of or inability to use our website or digital services.

Nothing in these Terms is intended to exclude or limit liability to an extent prohibited by applicable law.

Liability associated with participation in physical activities may also be addressed by separate waivers or participation agreements applicable to those activities.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Motion X Millie LLC and its owners, employees, instructors, contractors, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of our website or digital services, your material violation of these Terms, or your infringement of another person’s rights.

21. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

To the extent a dispute arising from these Terms may lawfully be subject to an agreed forum, the parties agree that proceedings will be brought in a court of competent jurisdiction serving St. Bernard Parish, Louisiana, unless applicable law requires otherwise.

22. Changes to These Terms

Motion x Millie may update these Terms periodically to reflect changes in our services, business practices, technology, policies, or legal requirements.

When we update these Terms, we will post the revised version and update the Effective Date above.

Changes will apply prospectively as required by applicable law and will not alter existing contractual rights or obligations where additional notice or consent is legally required.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and any applicable purchase agreement, membership agreement, waiver, participation agreement, or other terms presented for a particular service, constitute the applicable agreement between you and Motion x Millie concerning the subject matter they govern.
